Although it is difficult to guarantee what happens to controlled items after they leave the exporting country, companies that manufacture and export licensable goods must employ their best efforts to determine that the ultimate consignee and/or purchaser intend to use the product in an approved manner. Determining end-use is critical in cases where an item that is exported could be used for both military and civilian purposes.

End-use surveys can help determine if an intended use is in compliance with export regulations by asking questions based on the product, origin, and destination. For most companies today, this is largely a manual process that is difficult to administer, especially across a global enterprise.

Challenges include:

  • Collecting information from all associated trade partners and integrating it with compliance and supply chain operations
  • Ensuring end-use questionnaires are completed on a consistent basis
  • Storing, managing, and retrieving responses to particular questions
  • Determining significance and corrective actions based on the responses
  • Maintaining the information and recertifying as required by internal policies

Amber Road's questionnaire functionality generates end-use surveys for the parties involved in a transaction. The process can be managed centrally and distributed to all employees that must interact with customers, suppliers, or contractors of third party companies.

Questionnaires can be developed by business unit, transaction type, origin country, and destination country. Based on a description of the intended transaction, an end-use survey is dynamically attached to the transaction of interest.
An internal party to the transaction is given access to the questionnaire system, and prompted to answer each question based upon their knowledge of the receiving party. In addition, all parties to the transaction undergo restricted party screening as part of the process.
Once a questionnaire is completed, scoring algorithms can automatically flag the transaction for further review and corrective action. In addition to securing the compliance process, questionnaires also demonstrate due diligence when faced with an audit or security assessment.
