Amber Road, Inc. and its affiliated companies, collectively referred to in this Privacy Policy as Amber Road, recognize and respect the importance of individual privacy and value the confidence of its customers. It is our goal to balance the benefits of international electronic commerce with the preservation of individual privacy rights. Most of the information that we handle is not collected on this website, but rather through relationships we have with customers and other companies.  We nonetheless provide this Privacy Policy as a service to clients, consumers and others who want to learn more about the data we handle and how we use it.  This Privacy Policy applies to all of the products and services offered by Amber Road and describes how Amber Road collects, uses and discloses personally identifiable information obtained through its website located at www.amberroad.com (“Website”) and via other methods. By using the Website or submitting any personally identifiable information to Amber Road, you acknowledge that you have read, understood and agree to be bound by this Privacy Policy and Amber Road’s Terms of Use located at www.amberroad.com/content/terms-use.

This Privacy Policy also describes certain matters related to the EU-US Privacy Shield and Swiss-US Privacy Shield frameworks.  Amber Road has certified that it adheres to the EU-US Privacy Shield and the Swiss-US Privacy Shield framework. Collecting Your Information 

Amber Road collects data to provide customers with products and services, and to operate Amber Road’s business such as when certain data is input and stored in our subscribed-to software applications in order for a customer to use our global trade management products or services.  Some of this data is provided directly, such as when you create an Amber Road account, connect to our Cloud service, or contact Amber Road for support. Amber Road also receives some data by recording how users interact with Amber Road products and services by, for example, using technologies like cookies, receiving error reports or usage data from software running on Amber Road’s cloud or utilizing Amber Road’s services.

For the purposes of this Privacy Policy, the data that Amber Road collects includes "personally identifiable information," which means information concerning a natural person that can be used to identify such person. This Privacy Policy only pertains to personally identifiable information that is collected by Amber Road through the Website or through other methods as described herein. The personally identifiable information that Amber Road collects depends on the products, services and features used, and can include the following:

Disclosure of Your Information

Amber Road does not share personally identifiable information with companies, organizations or individuals outside of Amber Road unless we have your consent, it is necessary for business operations or as mandated by legal requirements.  Subject to the foregoing statement, Amber Road may share and disclose your personally identifiable information and other data with its: (1) business partners, (2) affiliates, (3) subsidiaries, (4) legal representatives, (5) sales agents, (6) independent contractors, and (7) third-party vendors and suppliers for Amber Road's business purposes described above. 

Amber Road reserves the right, subject to the requirements of applicable law, to share your personally identifiable information and other data to respond to a duly authorized information request of governmental authorities, where required by law or in situations where Amber Road believes that it is necessary to identify, contact, or bring legal proceedings against someone who may be misusing the Website or Cloud, interfering with the rights of Amber Road or other users or when Amber Road reasonably believes that the law requires or permits such disclosure. We may also provide your personally identifiable information to a third party in connection with the sale, assignment or other transfer of the business of Amber Road. Without limiting our obligations under our Privacy Shield Privacy, if you are located outside of the United States please be aware that any information that you provide to Amber Road through the Website may be transferred to the United States. Pursuant to applicable regulations, Amber Road maintains reasonable physical, technical and administrative procedures to protect data including personally identifiable information against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access, but Amber Road cannot ensure or warrant the security of any data against any possible loss or unauthorized access.

With respect to personally identifiable information provided by individuals located in the European Union countries and Switzerland, Amber Road adheres to a self-regulatory program that is designed to comply with the privacy principles of notice, choice, onward transfer, security, data integrity, access and enforcement as set forth by the U.S. Department of Commerce in the EU-U.S. Privacy Shield and Swiss-U.S. Privacy Shield Frameworks. Disputes

You should first contact us with any complaint regarding our receipt or handling of your personally identifiable information via email at privacy@amberroad.com or as stated in our Privacy Shield Policy as applicable.  If we are unable to resolve your dispute in a mutually satisfactory manner, the dispute shall be submitted to the American Arbitration Association's international division, the International Centre for Dispute Resolution ("AAA/ICDR") for arbitration, pursuant to the AAA/ICDR Privacy Shield program.
